British government has refused to hand over former president Pervez Musharraf to Pakistan who is wanted by joint investigation team in Benazir Bhutto assassination case.
Anti Terrorism Court (ATC) which is conducting trial in Benazir Bhutto assassination case has summoned Director FIA and head of joint investigation team Wajid Zia on next hearing of the case taking place on April 9.
FIA presented written repot of British home department to court, which was sent by Pakistan High Commission. As per this report no formal extradition treaty existed between Pakistan and UK, therefore, arrest warrants of Pervez Musharraf could not be executed.
Chief Prosecutor Chaudhry Zulfiqar told that the arrest warrants of Pervez Musharraf issued by the court were sent to British Home Department and Pakistan High Commission through foreign ministry. Pakistan High Commission had intimated about Pervez Musharraf address in London and arrest warrants were also sent on this address.
Talking to media men Chief Prosecutor Chaudhry Zulfiqar and Muhammad Azhar Chaudhry told claimant of this case police inspector Kashif Riaz was trying to flee from the country. Punjab Police has recommended for sending Kashif Riaz abroad. Upon it we have recommended for placing his name in ECL.
To a question they told Pervez Musharraf had major role in this case and his arrest would be ensured. Decision had been taken to seek help from Interpol, they said. It seemed as if some sympathizer of Pervez Musharraf was there in foreign office, they stated.
If Pervez Musharraf does not appear deliberately then the court had authority to declare him proclaimed offender and confiscate his property in Pakistan after initiating proceedings against him under section 87 of criminal procedure, he held.
